Affidavits are the basic document used in court proceedings, used in place of long interviews or even absences in the court. As this document is going to be read by solicitors and magistrates it is important that an Affidavit is correct in all its requirements. The basic duty of a Justice of the Peace in servicing an affidavit is to make the person swear and oath or make an affirmation as to the truth of the affidavit.
Statutory Declarations are a very common document used for persons to make a written declaration as to the truth of the content of the document. Witnessing Statutory Declarations is relatively easy but make sure by following this link.
Powers of Attorney are not necessarily an issue that relate to Justices of the Peace but it is an every day issue that people should consider when they get older. To appoint a Power of Attorney for yourself will allow that person to act on your behalf, in accordance with your instructions, while you are away or incapacitated.
The New South Wales Justices Association adopted this Code of Conduct for its members at the Board Meeting on 15 June 2004. While the "policing" of such a code of conduct is near impossible, this code of conduct should be used to act, in all ways, in a proper manner, befitting of the position of Justices of the Peace in New South Wales.
